About us

The University of Bedfordshire, University Square, Luton, Bedfordshire, UK, LU1 3JU (“us”, “our” or “we”) provide content and features for the iSort via: www.isort.co.uk (the “Website”) and web application (hereafter “Web App”). We refer collectively to the iSort Website and Web App as the “Site”.

About our terms and conditions

These Terms and Conditions (these “Terms”) govern your access and use of the Site. The term “you” refers to the user of the Site. By using this Site, you indicate that you have read and understand these Terms and agree to abide by them at all times.

Protecting your personal information

Protecting any personal information that you provide via our Site is extremely important to use. You can find out about our privacy practices in our Privacy Policy (“Privacy Policy”). You acknowledge that your use of our Site is also subject to our Privacy Policy. You further acknowledge that your use of the Site may include the processing of “special categories” of personal data, including your race or ethnicity, sexual orientation or information about your health. This information falls under the “special category” of personal data under the GDPR which you can learn more about in our Privacy Policy. We do not automatically collect special category data.

You agree that the Site is not to be used in a medical emergency. If you are experiencing a medical or mental health emergency, please contact 911 or go to the nearest Accident and Emergency department. Please do not attempt to access emergency care through our Site.

Accessing our Site

When using our site, you must comply with the provisions of our Acceptable Use Policy (below). You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms, and that they comply with them.

Registered users

Some areas of our Site are reserved for “Registered Users” return only. Registered Users are restricted to organisations within the Bedfordshire, Luton and Milton Keynes health and care partnership, members of Research in Practice and Buckinghamshire Health and Social Care Academy. Students based within the Faculty of Health and Social Sciences at the University of Bedfordshire can also access the app for free.

Guest users

A visitor to our Site who has not created an account or using their login is a “Guest User”. These Terms apply to Guest Users.

What you’re signing up for

To benefit from all features of our Site, you will need to be a Registered User and create an iSort account. There are separate accounts for organisational and individual users. The Web App generates diagnostic information regarding organisational and personal resilience using survey data that you provide and maintain. Depending on survey results, you will be signposted to evidenced based strategies and resources designed to support organisational and personal resilience.

Guest Users can access content available to Registered Users for free via our iSort workbooks and toolkits for organisational resilience and personal resilience. However, accessing the interactive features of the diagnostic tools are dependent on creating an iSort account as either organisational or individual user.

Intellectual property rights

As a user of our site, you may print off multiple copies and download multiple documents. However, you must not modify the paper or digital copies of any materials you have printed off or downloaded in any way. Our status (and that of any identified contributors) as the authors of material on our Site must always be acknowledged.

All materials (including but not limited to software and content whether downloaded or not) contained in our Site (“Materials”) are the sole property of the University of Bedfordshire. This includes but is not limited to text, logos, documents, downloadable files and anything that contributes to the composition of our Site. We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Reproduction of these martials are prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

General rules of use

When you create an iSort account, or otherwise access our Site, you agree to be bound by these Terms and all applicable laws, rules, regulations, judicial orders, executive orders or similar binding legal instruments (“Applicable Law”). If you do not agree to these Terms, please do not use the Site.

If we have reason to believe that there is likely to be a breach of security or misuse of the iSort Web App through the account you have created, we may require you to change your password or we may need to suspend your account. Until we are satisfied that your account is secure, you may not be able to access the Web App.

Changes to these Terms

These Terms may be amended from time to time to comply with law or best practice and to reflect any changes to the way that we operate the Site. We will notify users of by email of the changes to these Terms or post a notice on our website.

Acceptable use policy

By using the Site you agree to not:

a)  Access the Site in an unauthorised manner, including in violation of any local, national or international law or regulation

b) Knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware

c)  Perform any fraudulent activity including impersonating any other person or entity while using the Site

d)  Transmit any material that is defamatory, offensive or otherwise objectionable (including, but not limited to, bullying, harassing, or using hate speech or degrading comments about things like race, religion, culture, sexual orientation, gender or identity, age or disability)

e)  Use the Site for any purposes related to scientific research, analysis or evaluation of our Site without the express written consent of the University of Bedfordshire

You also agree to not:

f)   Reproduce, duplicate, copy or re-sell any part of our Site in contravention of the provisions of our Terms

g)  Use the Site (or any part of them) to create any tool or software product that can be used to create software applications of any nature whatsoever

h)  Access without authority, interfere with, damage or disrupt: any part of our Site, any equipment or network on which our Site is stored, any software used in the provision of our Site, or any equipment or network or software owned or used by any third party.

We reserve the right to immediately terminate your access to or use of our Site if we believe, in our sole discretion, that you exhibit such behaviour or you violate or attempt to violate any laws or breach these Terms.

Availability of our Site

Although we aim to offer you the best Site possible, we make no promise that the Site will meet your requirements and we cannot guarantee that the Site will be fault free. If a technical fault occurs, please report your concern to info@isort.com and we will review your concern and correct the fault where we determine it is appropriate. If the need arises, we may suspend access to the Site while we address the fault. We will not be liable to you if the Site are unavailable for a commercially reasonable period of time.

Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new features or resources. We will restore the Site as soon as we reasonably can.

We may change or discontinue, temporarily or permanently, any feature, component, or content of the Site at any time without notice to you.

Third party terms and links

You may follow links contained in our Site to third-party websites that we do not own or control. We are not responsible for the content, policies or practices of any third party website or service linked to our Site. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using them.

Our liability

The material displayed on our Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other Terms and Conditions of Use which might otherwise be implied by statute, common law or the law of equity
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including:

a. loss of income or revenue

b. loss of business

c. loss of profits or contracts

d. loss of anticipated savings

e. loss of data

f. loss of goodwill

Wasted management or office time; and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Jurisdiction and applicable law

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
